1. Acceptance of Terms

By downloading, installing, or using the SafeTanning mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use SafeTanning. If you are under 18, you confirm that you have your parent or guardian's permission to use the App and to any applicable subscription.

By using the App you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

3. Description of Service

SafeTanning provides a UV forecast-based tanning planning tool. The App:

• Fetches real-time UV index data for your location
• Generates a personalised tanning schedule based on your skin type, tan goal, available days, and the UV forecast
• Provides a step-by-step session timer and SPF guidance
• Sends optional push notifications to remind you of your tanning window

All session recommendations are estimates based on UV forecast data and generalised skin type parameters. Individual results will vary.

4. Health & Safety Disclaimer

Sun exposure carries inherent risks including but not limited to sunburn, premature skin ageing, and increased risk of skin cancer. SafeTanning is designed to help you tan more responsibly by targeting lower UV windows and recommending SPF protection, but it does not eliminate these risks.

You acknowledge that:

• UV forecast data may not be perfectly accurate for your exact location
• Individual skin sensitivity varies and may differ from the Fitzpatrick scale generalisation
• Environmental factors (reflection from water, sand, or snow) can increase effective UV exposure beyond what the index suggests
• Medications, cosmetics, and medical conditions can increase photosensitivity
• You are solely responsible for monitoring your own skin's reaction and stopping sun exposure if you experience discomfort or burning

Always apply sunscreen with the SPF recommended in the App, seek shade immediately if you experience any burning or discomfort, and consult a dermatologist if you have concerns about your skin.

5. Subscriptions & In-App Purchases

SafeTanning offers a free tier and a paid Pro subscription. Subscriptions are managed and billed through Apple App Store or Google Play Store.

• Free trial: Where offered, the free trial converts to a paid subscription at the end of the trial period unless cancelled before the trial ends.
• Billing: Subscriptions are billed in advance on a monthly or annual basis and auto-renew unless cancelled at least 24 hours before the renewal date.
• Cancellation: You can cancel at any time through your App Store or Google Play account settings. Access continues until the end of the current billing period.
• Refunds: All refund requests are handled directly by Apple or Google under their respective refund policies. We do not process refunds directly.
• Price changes: We may change subscription pricing with reasonable advance notice. Continued use after the price change takes effect constitutes acceptance.

6. Intellectual Property

The App, including its design, code, content, logos, and all related intellectual property, is owned by SafeTanning and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.

7. User Content

Progress photos you add to the App are stored locally on your device. You retain all ownership and rights to your photos. We do not access, upload, or use any photos you add to the App.

8. Third-Party Services

The App relies on third-party services including a UV index API for forecast data. We are not responsible for the availability or accuracy of data provided by these third-party services. Use of these services is subject to their own terms and privacy policies.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses
• UV forecast data will be accurate for your specific location or conditions
• Tanning plans will produce any specific result
• The App will be available in all geographic regions

10. Limitation of Liability

To the fullest extent permitted by applicable law, SafeTanning and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Sunburn, skin damage, or any adverse health outcomes from following App recommendations
• Loss of data resulting from App deletion or device failure
• Interruption or unavailability of the App or UV data service

Our total liability to you for any claim arising from the use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim, or €10, whichever is greater.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion.

You may stop using the App at any time. Uninstalling the App ends your use and removes all locally stored data.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

If you are a consumer in the European Union, you may also have the right to seek redress through the EU Online Dispute Resolution platform.
